I think this should be resolved as INVALID. The bug description talks about a
case that at best belongs in the realm of how ECMAScript regular expressions
normatively reference Unicode.

The case-(in)sensitivity terminology in the HTML 5 spec is only for the
algorithms given elsewhere in the HTML 5 spec.
